ok so i was at the drumlin diner and i accidentally pick-pocketed Trudy or Patrick and i have done the usual wait/sleep 3 to 6 days and they wont become passive and every time i go there they keep trying to kill me...

Where did you wait? Was it somewhere nearby or at the far flung ends of the map?

Your best bet is probably to reload an earlier save.
