I just noticed that the ingame vsync doesn't save and even though it shows its on in reality it isn't and my GPU is thrashing. I want it capped and don't want any screen tear. Can anyone else confirm this on their setup?

Enable it in your graphics card settings and not in-game. If you have V-Sync turned off in your graphics control centre then it won't enable in any game.
