What should I do when I cannot contact the author?

I'm looking for the community's advice on this.
I recently came across Sage Rime's "Skyrim Armory" on TESNexus. I was happy to see that it includes Stalhrim armor and weapons, as I've been wanting to include that set in a future release of WEPON.
The file's credits and permissions section was never updated (so it still reads the default "you must contact the author to gain permission to reuse this file"). When I tried using the messaging system to contact him, I received an error message that "this user cannot use the TESNexus messaging system"; and his profile states that he is retired.
After some further investigation I noted several other cases where Sage Rime had given permission for reuse of his various mods.

In this situation, where the author cannot be reached for permission, what would you do?

Personally I would not use it -- figure the readme states that you must contact him for reuse and if you are unable to contact him then I would not reuse it. -- You might also try contacting the others listed in the credits to see if perhaps one of them actually made the armor models and would give permission for use.

Actually after looking at the pic that looks very much like Ghogiels Ice armor --- http://www.tesnexus.com/downloads/images/10775-1-1194125927.jpg from his http://www.tesnexus.com/downloads/file.php?id=10775 !! -- In which he says :

Models & textures may be used and released in in your own mods that have been created for TES4 Oblivion ONLY. Under the condition that the correct credits have been given; You respect the modders code. If you release a mod containing any of the game assets contained in this compliation, In whole, modified or in part, You must include this readme file with that mod. No neon pink and purple retextures allowed, rofl ;). All rights reserved and any permissions can be revoked simply at the will of the copyright owners.


So looks like that armor was actually made by Ghogiel and then the texture modified and released by Sage (which is probably why he did not give permission for use since it was not his original work to give permission for. ) So you should be fine reusing Ghogiels original version (or modifying the texture as you want using his model - as long as you give proper credit and include the readme from his armmor resource in your mod package as requested !

Hmm...yes, that's a pretty blatant reuse of Ghogiel's original armor. (I took a look, and Ghogiel's set was posted in 2007, while Sage Rime's was in 2008.) Thanks for pointing it out.
That said, I must have a matching armor and weapon set for WEPON; and Ghogiel only designed the armor. So I'll still need to use Sage Rime's version if possible.
I may see if I can contact him on other forums...
