Whats up with the flag : Fallout Series Discussion

Is there any explanation for the version of the American flag used in Fallout 3? For example, look here:

The flag has 12 stars (with one big one in the middle), it's somewhat similar to the Betsy Ross 13 star flag http://www.gamesas.com/index.php?act=findpost&pid=0. Was there some merging or loss of states? We can assume at the point that the Fallout universe breaks away from the real world, they were using the 48 star version (http://www.gamesas.com/index.php?act=findpost&pid=0), and we would assume that Alaska, at least, joined the union, so how'd we end up at 13 stars?

Prior to the Great War, the United States had an intermediate level of government between the state and federal powers. In the early 21st century, the nation was divided into thirteen commonwealths. The United States flag was changed as well. The new flag depicted 13 stars in a circle and one in the middle. The middle star probably represented the unity of the nation.

Even if we accept that its defiling the image (which I do not), America has this funny little thing called "A bill of rights". This bill of rights guarantees even more pecular things like "Freedom of speech" and "Freedom of Expression". You can defile the flag all you like, heck, you can even pretend to burn it like Pen and Teller do, and the law cannot touch you.

Bethesda would love the free publicity, and the prosecutor would be laughed out of court so roaringly the case would become known as the "http://en.wikipedia.org/wiki/Shot_heard_round_the_world".

BTW, I assume the guy who suggested prosecuting Bethesda was, you know, kidding.

Edit: Then again, I might have been searching under Fallout 3. I hadn't even noticed that there was a whole other sub section of Fallout related forums (this post was helpfully moved by the mods).
