When can I demand my money back? (serious thread)

Dear Crytek/EA(/whoeverisresponsibleforthat),

I pre-ordered Crysis 2 Limited Edition. I payed almost 50€. I obviously bought this game because of the multiplayer. The problem is the following:
- I prefer to play Team Instant Action and Crash Site because I dont like the other game modes.
- I dont have the very best connection so I have to make sure I get a good server too achieve a ping under 100 (otherwise I lose due to my bad connection which ofc isnt fun).
I filter these servers and when I finally find one with said criteria that isnt full, what do I also find? ....at least one cheater on it.
Yes, this is a known issue and you're working on it but your efforts dont seem to have success whatsoever.
I'm not a totally impatient person (I also had the stupid log in issue and had to use another nick to be able to play multiplayer after I called support, read in forums and noone could help me) so I would wait some more time because without cheaters the multiplayer is a hell of a lot fun but my serious question now:

When can I demand my money back because of not rendered services?

Yea, call EA support so you can waste your time. Do you really think...and I mean REALLY mean this...Do you seriously think that they will refund you your money back?

concerning law everything you buy has to work properly. If thats not the case you have the right to get a replacement (not practicable in C2 cause it's not a "physical" issue) and if it still doesnt work you have the right to get your money back at a certain point.

EA support can refund your game only if you bought the game from the EA online store which is what I did and I got my game refunded, I might repurchase it IF the game gets fixed, and by then it will be cheaper.

also the fact that his game works means he cant get a refund just because there are cheaters in his server.


explain how it is not services rendered since you can play online?

There will most probably be an exclusion clause somewhere in that long EULA you skipped and just pressed "I Agree" to that makes you ineligible for a refund.
That and the game seriously isn't that broken, I play 300ping servers and everything goes fine most of the time.

You could probably claim that you bought the game under the assumption that it was going to have graphics far better than Crysis 1 thereby making the condition under which you bought the game invalid and entitling you to a refund. You could even claim that Crytek's claims of better graphics were fraudulent and sue for damages... but really... why would you bother, its a pretty good game, I remember that Black Ops had FAR more problems when it came out :S

It depends on the consumer laws governing your country and or where you purchased the game from.

If for example you live in the UK and purchased a DVD from a retailer they are governed by the 'Sale of goods act', so you must contact your retailer within 28days. Its then for the retailer to argue with EA, its their problem though most likely they will write it off if they only have a small number to return.

If the retailer refuses to refund the game you will need to write a letter to their head office and make a complaint that your consumer rights have been breached and explain why. Basically your argument is that your PC meets the stated system requirements but the game does not perform as advertised and you have tried to get technical support or information from the publishers and they have failed to help.
