I don't know about the legal status in the US, but in the UK your contract is with the retailer, not the manufacturer. So if you buy a faulty product, you can take it back to the store, and the onus is on the retailer to prove it's not faulty if it's returned in the first six months. A lot of UK stores try and palm that off onto the manufacturer, but that's the legal situation in the UK.

and please do so. No harm, no foul. Also, anyone else who wants nothing else but to complain please cancel your forum account. Most of us are enjoying our game and would really like to discuss our issues and what not in a civil and friendly manner.



Clearly you didn't read this thread through carefully.

It may be different in pockets of places (I am thinking certain countries make vendors accept soft ware back - but that ain't the case in the US of A) - but, for the most part, you cannot return this game for a full refund. I'll say it again - you cannot return this game for a full refund, only it's trade-in value. Which, from the posts I've read on this forum - has plummeted to less than 1/2 the retail value. (Gee Whizz, ya wonder why that might be? ::COUGH COUGH:: bugs maybe?)

As for canceling forum accounts - you know, it just doesn't work that way. (That said in Lilly's admonishing grandmother voice). We gamers who've been screwed by a faulty product that should have never shipped in it's current state, must have SOME recourse . These forums are that recourse. :)

Now, you have two options - YOU can cancel your account, or, you can exhibit some self-control and opt out of reading the posts you don't like.

Easy peasy!

The US offers no such protection to the buyer. We are, SOL. Oh - and thanks for giving an example to my point in my previous post (ie - some places may require vendors return software for full refund).

Maybe they will change there ways if we throw a class action lawsuit on them.



This is really what needs to happen. It would set (I think?) an important and much needed precedent.

Same here in Sweden - the retailer literally has to prove a negative (that your game is NOT broken) for the first 6 months. After 6 months, you're still covered for another 18 months (although then you have to prove that it IS broken, and was when you bought it).

That's why you can usually get a refund if anything is legitimately broken here in Europe - we just return our stuff to the retailer who usually couldn't care less, since they'll just charge the manufacturer. The manufacturer can't afford to stiff their own distributors.

HOWEVER! There is a big but here, and that is that the law allows that the manufacturers can also opt to repair the faulty product "in a timely manner". This must be done at no or negligible cost to the customer, and be done within a reasonable time. What constitutes a reasonable time is up for discussion, but 6 weeks is usually the upper limit (and it depends on the product). This is the option taken both by Microsoft with RROD and Sony with YLOD.

I therefore think, sadly, that a comprehensive patch definitely falls within the definition of a timely repair, if it appears before December.

The damage that is has caused is $60 out of my pocket for a game I cannot even play due to the extreme amounts of errors in the game it has also caused a MAJOR PS3 system failure which (if it wasn't for the fact that Sony was very willing to help me pro-bono to fix the problem this game caused) could've resulted in a completely unusable/unsaveable PS3 resulting in a $250-$400 purchase for a new system. I would say that this would be a HUGE damage to me (or anyone) in this economy!!! If I had to replace my entire system because of this game I would REQUIRE that Bethesda pay me to refund my purchase of the game AS WELL as the reimbursemant for the new system I would have to purchase due to the fact that this game destroyed my PS3!!!!!

If I could get a complete refund for this game I would MOST DEFINITELY take it! We loved FO3 and were looking forward to this new game but I WILL NEVER buy from this company again as they clearly were aware of these problems when they released the game and decided to release the game to get their numbers in sales (greed and gluttony are 2 of the 7 deadly sins Bethesda!!!) instead of adjusting the release date to ensure the game was almost completely bug-proof. These aren't just bugs some people are experiencing, these are MAJOR game errors that are causing MAJOR system errors, including entire system crashes that result in unfixable systems and these kinds of errors/bugs are inexcusable!!!

I contacted Bethesda regarding a refund since I was unable to return it through the store I purchased it from. They said that Bethesda will only refund the game if it was purchased directly from them. Ironically it wasn't possible to buy F:NV from Bethesda. I obtained the address for their customer service reps and mailed a letter requesting some form of refund for this unplayable game that I received. I'm sure many of you, like me, just want this broken game gone from my life, and my money returned. The example I used was that "If i buy a tv, and it only works in 15 minute intervals, and freezes the picture on the screen then it would be considered broken and a refund would happen." just really disappointed....

I'm sure you realize this entire situation was entirely calculated when they released the game, as is.

This is a console game crashing/bugging/locking etc. NOT a PC game. There's ONE single interaction - the game, and the PS3 - period.






In any other industry if a company consistently sells defective products - there are repercussions. It isn't about "damage", it's about selling a product AS ADVERTISED. The product is advertised TO WORK - and yanno? It just doesn't for far too many people.

Leave to a gamer to defend the indefensible.

Actually they did not advertise the game would work. If there was then they held true. the game works but does not work to 100% performance. Also the game is not "material" if you will, the problems are digital and can be fixed with coding and is therefore not in the realm of being completely defective.

Whats the difference between PC and console besides coding. The gaming comps are just as good as our console; same for the gaming content. And yes i am fully aware i will get slammed by people, its a given and you know what i dont care because you people are completely biased to "we hate Bethesda" and "their doing nothing and dont give about us". The thing is they ARE doing their best to produce a complete product. For once, look at both sides views, problems, etc. and then make am EDUCATED decision. Dont bother responding to this if your going to be biased to either side, and yes i am upset that the product is not at peak efficiency, but im willing to wait for a fix (which is near) and not complaining and demand my $ back, be serious its NEVER going to happen (baisically this post, and any others before and after this are pointless). GOOD DAY :D

I want my money back. I have spent only a few hours playing this game and have become so frustrated by the freezing that I have given up. I did not pay $59.95 to be a beta tester. I will happily return your video game to you, if you pay shipping and handling, upon completion of my refund. I will not return the game prior to completion of the refund as your company has made it very clear you have no integrity by selling a product you knew did not work. I am certain your company will not respond to this comment. That said, I would like to know how many other people on Bethesda's website wants to get a refund.


I got the Fallout New Vegas Collector's Edition and it 80$ + Fallout New Vegas Collector's Edition Official Strategy Guide 35$! 80$ + 35$ = 115$ So didn't spend 115$ for a game i can't play! That my Hard Earned Cash!

Obsidian and Bethesda "WE" I Said "WE" "We are not your beta testers! We are the Customers and this should have "BEEN FIXED BEFOR RELEASE" Not after! We know your working hard or not on this Patch that shouldn't be "NEEDED"! Im not try to start any thing but this is unbelievable! Were are your beta testers? That's funny. The commercials that * I* saw, showed the game as functioning. In them, I didn't see black screens, lag (well except for the advert on the cab LCD) , crashes, graphics glitches, or inabilities to complete key quests that advance the story line to completion.

As for "not working 100% to performance" - I think many people here would settle for FIFTY percent of performance - cuz they are getting ZERO performance.

Look at both sides? You're joking?

The "sides" are -

Side 1) Bethesda/Obsidian, who knowingly released a game that was not ready to be released. In addition to the simple annoying graphic glitches/ bugs (which are to be expected in a game release), there are FAR too many issues with (and I'll use caps for emphasis, since you don't seem to understand this: MAKES THE GAME COMPLETELY UNPLAYABLE FOR FAR TOO MANY PEOPLE.).

Side 2) Consumers who paid a good amount of money for a game they expected, as fully within their RIGHT to expect, - to BE ABLE TO PLAY.

Again, defending the indefensible. It boggles the mind.

These forums are that recourse. :) No it is not...they dont read these forums for just this reason. Plus the game isn't "faulty". It is a modern software that needs to be patched.

Now, I have two options - I can cancel my account, or, I can exhibit some self-control and opt out of buying games that aren't COD or HALO. There ya go I fixed it for ya. I know it gets confusing sometimes.
