I think that it is better if they let us decide why we were put in the prison, so the game starts like this:
You start in a cold and damp room, filled with chilling, windy, and moody atmosphere, you are lying down on a small bed, in a corner there is a cracked mug and a half broken clay plate.
You sit up in the bed and look around, and in this moment, a guard comes into the room and tells you to follow him, and the control is given back to the player.
You follow him through the narrow and damp passage way to the prison's office, and look around to see several guards at their posts, and in front of you is the equivalent of "Socucius Ergalla" form Morrowind.
The guard who fetched you closes the door behind you and stands beside it.
You talk to the Official, and he greets you, and asks your name, and then looks keenly at your face commenting that your face seems familiar, a dialog opens in which you can define your race, body type and face.
Then he asks about your background and previous profession, and you can select one from several possible ones, for instance:
"Nobleman second son/daughter" and "a veteran fighter".
"Slum dog brat" and "Pick pocket".
"Wandering commoner" and "Alchemist apprentice".
And so on, and those backgrounds and professions would add their perks and buffs to your character and his skills.
Then he asks about your birth sign or any other choices that they like to add to the Skyrim, and you answer those choices or select from the lists.
Then the official gives you a list to see if he has got it right and you can modify your selections and even return to the race, body and face menu and change those, and in the end you are given the chance to change your current skill levels as you like, but within their minimum, and maximum range, which is defined by a combination of your previous choices.
There is a minimum and maximum limit for the range that you can alter any of your skills, and you can do that by 5 level steps, and decrease some to increase the others, and there is a pool that would decrease any time that you increase any skill, and it would increase any time that you decrease a skill, and in the end that pool should be at zero, to let you to finish the dialog.
Your attributes are defined by your previous choices and your current skill levels, and as you change your skills, you can see their effect on your attributes.
Then accept the changes in the form, and give it back to the official, and he takes another look at it and makes a comment about your background like this:
"Hmm, a professional pick pocket, this leads to this office for sure, no?"
Or
"Hmm, an alchemist apprentice, I wonder why you ended up here?"
After that you tell him that: "it started like this...", and start to tell him about your previous life, and in a flash back, you start from somewhere else which depends on your selection of background and previous profession, so you would be on your selected setting, somewhere in the game world, and you would be given some initial introducing simple quests to help you into the game, but the setting, and those quests differ for different choices of background and profession.
After that you are free to do as you like, and just like in Fallout new vegas, if you want to wander off too far from your spawning point, you are given another chance to review your initial choices, except for background and profession of course, hoping you know what you are doing now.
The background and profession are no big deal and define your starting place and a bit of boost and perks, and starting new character might start you in another area with other initial quests, if you like.
After that, the first time you are arrested and taken to a prisoner in a specific county, the screen fades out and you stand before the official and he tells you that it was quite an adventure, and because you have entertained him a lot, he will bail you out for this time, and lets you take your previous staff before you were taken as prisoner and let the guards lead you out.
In your wandering around the official would be removed from the game world, so that you could not kill him and break the link, but after that you can do anything you like with him.
And early in the main quest when you are still a relative nobody, there can be a point that checks to see if you were not arrested beforehand, and if not you would be arrested, so that the story starts after that, and if there is no need to be arrested to fix the story, it can skip the prison part, and go to the next stage.
OK, that's another prison start combined with a "Dragon Age Origin" flavor and a bit of spice from yours truly.
