Would this be illegal.

The island I'm making isnt completely barren like the wasteland, and I would like to have additional tree types to use. Would taking trees from ES:IV and putting them in FO3 be copyright infringment and therefor illegal, or would it be ok since the same company made both games? I would love to use the trees, but not if its illegal >.> and I'm guessing it is, but hoping since same company, it might not be >.>

Ya cannot use the meshes/texture/anything found in Oblivion and uses in Fallout 3 and vice versa.

Yes, it would be a problem.

Taking models from one game and putting them in another is forbidden regardless of wether both games are made by the same company or not. Bethesda licenses many models for its games from third parties and that license only covers the one game they'll be used in.
So, no you can't take models from Oblivion and put them in Fallout 3 and vise verse.

Mods that have done so have been shut down quickly.

It is not allowed, as porting assets from one game to another is piracy.

Scripts are one thing since they are just lines of text, no issues there. Models are completely different and while Beth won't hunt you down if you transfer them between games for Personal Use, actually releasing the mod will result in a cease and desist order from Beth's lawyers.

Alright thats what I thought. Shame though :(. Thanks everyone, I can now make my mod without it being illegal and shut down after 5 seconds :P
